Transfer of Ownership and Deceased Estates
Break-down of a Marriage/relationship often entails the transfer of properties from joint parties to a sole party or other scenarios.
Death of a Loved one. When a loved one passes, often they are registered on a title to their property. This means you will need to lodge either an Application by Surviving Proprietor or an Application by Legal Personal Representative to remove them from title.
Inheritance. Similarly. when a loved one passes and you have inherited the property, you will also need a conveyancer to lodge a transfer once Probate has been granted to register the property into your name. A conveyancer is often less expensive than going to a law firm for a solicitor to complete this for you.
Transfer from Bare Trustee of a Super Fund to the Trustee of the Super Fund a Self-Managed Super Fund once the mortgage has been discharged.
Transfer between family members. Stamp Duty will be incurred in most scenarios and a conveyancer can assist you in determining the stamp duty and facilitating the transfer without the need of a contract.
Transfers from apparent owner to beneficial owner as well as holding properties in trust. Occasionally, there are situations that arise whereby the true owner (the person or persons that really own the property, known as the beneficial owner) are unable to be registered in title. Yet they pay the mortgage, property taxes etc, utilities such as gas and electricity.
